“There are those who want Kofi Annan’s plan to fail,” Mr. Lavrov insisted. “Today, those who from the beginning foretold the failure of Annan’s plan are doing a lot to see to it that this prophecy comes true? They are doing this by delivering arms to the Syrian opposition and stimulating the activity of rebels who continue to attack both government facilities and civilian facilities on a daily basis.”

The cease-fire remains “quite fragile” because of the reluctance of those outside forces to fully back the Annan plan, Lavrov suggested, although he added that Assad bears a share of blame for the continuing uncertainty. “Of course, government forces are also taking measures to react to such provocations, and as a result it is not all going very smoothly yet,” he said.

NY Times 26 Mar 1911

One hundred and one years ago today, the pages of the New York Times were filled with the story of the terrible deaths of dozens and dozens of workers ? most of them young immigrant women ? in a fire at 23 Washington Place in New York City affecting employees of the Triangle Shirt Waist Factory. The fire broke out on on the eighth floor of the 10-story building, and rapidly trapped the workers away from access to the stairs or the one fire escape. By the time the final victim was counted, it turned out that some 146 workers had died.

Today, you can find those articles available, for free, from the New York Times on the web. And every last one of them has the date of original publication ? March 26, 1911 ? and the notation that the document is ?Copyright ? The New York Times.?

No, it?s not. It used to be, sure, but it isn?t any longer, and there?s no good legal justification for the Times putting a copyright notice on these articles.

Sorry, but that dog don?t hunt.

The simple fact is that, under American copyright law, nothing, and I mean nothing, that was published in the United States before 1923 still has copyright protection. No book, no photograph, and no newspaper. Nothing.

And the law is quite clear that merely reproducing the original document in another format doesn?t have the necessary creative spark required to grant a new copyright in the new publication, not to mention the fact that the new copyright would only cover new material ? not material where the copyright has already expired. So the mere fact that individual articles are now being reproduced by the Times as individual PDF files and put online doesn?t restore copyright protection.

The law is so clear on these pre-1923 articles being out of copyright that ? even putting on my best ?what if I were the New York Times? hat ? I couldn?t come up with a single solitary theory that copyright could still apply. I looked all over the New York Times? website, and all I found there was the same kind of broad claim: ?all use of New York Times content (text, photographs, graphics, etc.) requires the permission of The New York Times.?

So I emailed the Times and asked one simple question: ?Since US copyright law clearly places all items published before 1923 in the public domain, what is the basis of the Times? claim that the articles are currently protected by a Times copyright??

The answer was, in part, just what I expected: ?Please be advised that article text published prior to January 1, 1923 is recognized as ?Public Domain? by The New York Times legal dept. ? Permission and licensing are not necessary to use this material.?

No foolin?.

So why is the copyright notice on these articles? A particularly apt question, since putting a copyright notice on materials that are absolutely unequivocally out of copyright can be a crime, though it requires a fraudulent intent ? something that?s most likely lacking here and awfully hard to prove ? and the penalty is only a fine ? not much to deter a major publisher.

I?m guessing that it?s there mostly because of the waffle in the Times? representative?s email reply: ?Please note this does not extend to the use of the publication?s logo, layout, or the content in any commercial/advertising/promotional forms.?

Well, okay, for the logo, I buy that there are potential problems with commercial or advertising use, but that?s because of trademark law, not copyright. Still, I?d be willing to bet that I could write and commercially publish a book about the Triangle Shirt Waist fire and use an image of the entire front page of the March 26, 1911, New York Times as my cover art without a trademark issue.

As for the layout and content, nope, that dog don?t hunt either. The fact is, everything about those pre-1923 works ? the layout, the content, everything ? has passed into the public domain. By definition, ?Works in the public domain may be used freely without the permission of the former copyright owner.?

I hate to clue in The Times, but ?freely? means just that ? and nobody, not even the great Grey Lady, can rewrite the language, or the law, to suit its wishes.

Genetics of flu susceptibility: Why the flu is life-threatening for some, and quite mild for others

ScienceDaily (Mar. 25, 2012) ? A genetic finding could help explain why influenza becomes a life-threating disease to some people while it has only mild effects in others. New research led by the Wellcome Trust Sanger Institute has identified for the first time a human gene that influences how we respond to influenza infection.

People who carry a particular variant of a gene called IFITM3 are significantly more likely to be hospitalised when they fall ill with influenza than those who carry other variants, the team found. This gene plays a critical role in protecting the body against infection with influenza and a rare version of it appears to make people more susceptible to severe forms of the disease. The results are published in the journal Nature.

A central question about viruses is why some people suffer badly from an infection and others do not. IFITM3 is an important protein that protects cells against virus infection and is thought to play a critical role in the immune system’s response against such viruses as H1N1 pandemic influenza, commonly known as ‘swine flu’. When the protein is present in large quantities, the spread of the virus in lungs is hindered, but if the protein is defective or absent, the virus can spread more easily, causing severe disease.

“Although this protein is extremely important in limiting the spread of viruses in cells, little is known about how it works in lungs,” explains Aaron Everitt, first author from the Wellcome Trust Sanger Institute. “Our research plays a fundamental part in explaining how both the gene and protein are linked to viral susceptibility.”

The antiviral role of IFITM3 in humans was first suggested by studies using a genetic screen, which showed that the protein blocked the growth of influenza virus and dengue virus in cells. This led the team to ask whether IFITM3 protected mice from viral infections. They removed the IFITM3 gene in mice and found that once they contracted influenza, the symptoms became much more severe compared to mice with IFITM3. In effect, they found the loss of this single gene in mice can turn a mild case of influenza into a fatal infection.

The researchers then sequenced the IFITM3 genes of 53 patients hospitalised with influenza and found that some have a genetic mutant form of IFITM3, which is rare in normal people. This variant alters the IFITM3 gene and makes cells more susceptible to viral infection.

“Since IFITM3 appears to be a first line defender against infection, our efforts suggest that individuals and populations with less IFITM3 activity may be at increased risk during a pandemic and that IFITM3 could be vital for defending human populations against other viruses such as avian influenza virus and dengue virus” says Dr. Abraham Brass, co-senior author and Assistant Professor at the Ragon Institute of MGH, MIT and Harvard and the Gastrointestinal Unit of Massachusetts General Hospital.

This research was a collaboration between institutes in the United States and the United Kingdom. The samples for this study were obtained from the MOSAIC consortium in England and Scotland, co-ordinated from the Centre for Respiratory Infection (CRI) at Imperial College London, and the GenISIS consortium in Scotland at the Roslin Institute of University of Edinburgh. These were pivotal for the human genetics component of the work.

“Collectively, these data reveal that the action of a single antiviral protein, IFITM3, can profoundly alter the course of the flu and potentially other viruses in both human and mouse,” explains Professor Paul Kellam, co-senior author from the Wellcome Trust Sanger Institute. “To fully understand how both the protein and gene control our susceptibility to viral infections, we need to study the mechanisms of the gene variant more closely.

“Our research is important for people who have this variant as we predict their immune defences could be weakened to some virus infections. Ultimately as we learn more about the genetics of susceptibility to viruses, then people can take informed precautions, such as vaccination to prevent infection.”

Sir Mark Walport, director of the Wellcome Trust, said: “During the recent swine flu pandemic, many people found it remarkable that the same virus could provoke only mild symptoms in most people, while, more rarely, threatening the lives of others. This discovery points to a piece of the explanation: genetic variations affect the way in which different people respond to infection.

“This important research adds to a growing scientific understanding that genetic factors affect the course of disease in more than one way. Genetic variations in a virus can increase its virulence, but genetic variations in that virus’s host — us — matter greatly as well.”

FCC mandates force costly update for two-way radios

Thousands of public and commercial mobile radios in the Dayton area are being reprogrammed or replaced to meet federal mandates intended to reduce harmful interference to public safety communication systems and make more efficient use of radio frequencies.

The mandates affect all two-way radio system operators, including police, fire, hospitals, utilities, schools, and commercial manufacturing and business.

The estimated $2.8 billion cost of “rebanding,” or moving public safety wireless radios in the 800 megahertz spectrum to new frequencies, is being funded by Sprint Nextel Corp.

Sprint Nextel will pay for the switch under a 2004 Federal Communications Commission order, according to a congressional report.

The FCC attributed most incidents of interference to public safety radio communications to “the network built by Nextel Communications,” now Sprint Nextel, the report said.

A separate, unfunded edict requires U.S. businesses and public service agencies operating VHF and UHF radio systems at 25 kilohertz to migrate to a more efficient 12.5 kilohertz frequency at their own expense by Jan. 1, 2013. Users who fail to meet the deadline risk fines up to $112,500 or the loss of their Federal Communications Commission license.

The FCC said the change will increase the available spectrum in the VHF and UHF private land mobile bands.

“It is very similar to what the broadcast stations did a few years ago going from analog to digital,” said Chris Hanes, sales manager for P&R Communications, a Day-ton-based wireless company with additional offices in Sidney and Toledo.

Hanes said the so-called “narrowbanding” affects anyone with a two-way radio license, particularly if they are using older equipment that is not capable of narrowband reprogramming. Those users will have buy new radios capable of operating in the narrower bandwidth, which range in price from several hundred dollars to $1,000, he said.

Rebanding will affect an estimated 40,000 U.S. public safety organizations that operate 800 megahertz wireless communications.

The result of rebanding will relocate the contiguous block of frequencies reserved for public safety, and create a separate contiguous block reserved for extended specialized mobile radio, primarily Nextel.

The FCC hired an independent transition administrator to coordinate the rebanding and payments to reimburse licensees for their costs.

Ensuring that the changes are made correctly is essential to public safety, officials said.

“When every single public safety agency in the entire United States moves frequencies at various times, you have to make sure that you are not overlapping frequencies with someone else,” said Shawn Waldman, director of IT and radio communications for the Montgomery County Sheriff’s Office.

Montgomery County this week completed a five-year rebanding effort to move the more than 2,000 communications radios used by its public safety agencies and public service departments to new frequencies. The $155,000 cost of rebanding will be submitted to Sprint Nextel for reimbursement, Waldman said.

In Montgomery County, narrow-banding will affect some fire stations and tornado sirens still on VHF frequencies. “We really don’t anticipate a large cost with narrow-banding,” Waldman said.

The Dayton Daily News in January reported that the nonprofit Victoria Theatre Association had to replace relatively new wireless microphone systems at the Schuster Center because the federal government sold the broadcast frequencies they previously used.

The Preble County Sheriff’s office used an estimated $500,000 in U.S. Department of Homeland Security grants over a five-year period to replace the county’s “antiquated” communications infrastructure, Preble County Sheriff Michael Simpson said.

“If we had not planned ahead after 9/11 and re-done all this infrastructure … it would have cost the county a big chunk of change,” he said.

Preble County upgraded from a single radio tower in Eaton to a five-site simulcast system that enhanced coverage areas, eliminated dead spots and prepared the county for rebanding.

In February, P&R Communications rebanded Preble County’s communications infrastructure and equipment, including 110 portable and mobile radios in Simpson’s office. “We were done in a day,” he said.

The cost of reprogramming is less than $50 per radio, Hanes said.

“Public safety has been more reprogramming because they have been up on that. Your local business is probably 50-50 from reprogramming to buying new,” he said.

The FCC mandated narrow-banding in 2004, but local efforts have accelerated in the last two years.

“There are a lot of cities and counties that have had this in their plans for years that are either done or will be completed here by summer,” Hanes said.

Dayton Public Schools upgraded during the 2010-11 school year to digital radios for school security resource officers and school buses, said Jill Moberley, a district spokeswoman.

“We made further upgrades this current year which allowed for distance and we also have GPS capabilities on our radios,” she said.

Dayton-area hospital and medical responder radios will be rebanded in late summer, said Patricia Bernitt, vice president of finance and emergency medical systems for the Greater Dayton Area Hospital Association.

Bernitt said radios remain important even though cellphones can be used at times for communications between first responders and hospital staff.?
